Patent Prosecution

Patent prosecution is the focus of our practice. This includes not only preparing applications and working with the patent offices, but also includes providing strategic patent counseling. To provide our high level of service, we first seek to gain a thorough understanding of the client's technology, business model, and competitors. This includes understanding the client's geographical markets, the product life cycles, the technology classes, product applications, existing licenses, and various other information to allow us to formulate an overall patent strategy or to revise an existing one.

Our attorneys are all experienced practitioners and most have significant litigation experience. Consequently, we thoroughly understand the scrutiny that your patents will undergo during litigation. We strive to get the broadest available patent protection to provide real economic value to our clients and a barrier to entry to competitors.

Finally, because we have built efficiencies into our firm, we can provide our top tier services at a very competitive price point, whether the fee structure is fixed fee or hourly. In fact, we know we are more than one third less expensive than many larger firms and, in the opinion of many of our clients, we provide better service. We urge all of our prospective clients to speak with some of our existing clients' counsel. We would be happy to put you in touch with some of them at your request.

Identifying Infringers

We are extremely excited to be able to offer a new and unique service. We will identify products and services that infringe your patents. If we are unable to identify any infringement, then there is no fee due. It’s a completely risk free proposition and, to our knowledge, a service not offered by anyone else.

Our agreed upon fixed fee is due only if we provide you with a claim chart that illustrates how one or more claims of one of your patents reads on a product or service ─ and you agree that our claim interpretation and infringement analysis are reasonable.

Benefits

Our service provides the following benefits to clients:
• allows you to monitor the activities of third parties that you learn are infringing;
• allows you to put parties on notice in order to start the toll of damages and/or willfulness;
• allows you to enhance revenues by seeking licensing fees for ongoing use of patented technologies; and
• allows you to seek damages for past infringement of patented technology.

Details

Our service is flexible and customizable. For example, you may select one or more of:
1. the patents and/or technologies you want us to pursue;
2. the third party products you want us to investigate;
3. the type of products you want us to investigate; or
4. the maturity of the patents that you want us to pursue.

After understanding your needs, we'll provide you with a fixed fee quote. If it's acceptable, we strive to provide you with the work product (a claim chart) in one to two months.

Licensing

We have ample experience in patent licensing, joint venture agreements, technology transfer agreements, and various other technology related contracts. Some of the work we do comprises complex licensing and other work includes simply drafting an intellectual property section of a larger agreement (such as manufacturing agreement). We also have experience representing clients seeking licensing terms, but who wish to remain anonymous to the patent holder.

Opinions

With success comes the increased likelihood of litigation. We understand this can help you steer carefully through what can sometimes be a patent minefield. We have significant experience in preparing non-infringement/validity opinions that are well founded in law and fact. In addition, we understand that we are significantly less expensive than many other firms providing opinion work.

Due Diligence

Prospective purchasers and investors want to understand the value of the patent assets of the acquisition or investment and the potential exposure to third party patent holders.
